Selling a private vehicle may result in a capital gain or loss for Income Tax purposes

The inquirer asks how to tax the sale of a private vehicle purchased 15 years ago. The DGT states that the transaction generates a capital gain or loss, but warns that losses due to consumption will not be taken into account.

The question raised

Taxation in Personal Income Tax (IRPF) regarding the aforementioned transfer of the vehicle.

The DGT's ruling

The transfer constitutes a capital gain or loss pursuant to Articles 33.1, 34, and 35 of Law 35/2006. Losses resulting from consumption shall not be accounted for as capital losses; therefore, it is not appropriate to account for a loss if the decrease in value is due to the normal use of the vehicle. The acquisition value must be substantiated by the purchase invoice or, failing that, by any means of proof admitted under Law.
