Capital gains from selling a primary residence may be exempt if reinvested in a property purchased up to two years prior

The inquirer asks whether the reinvestment exemption can be applied when using proceeds from the sale of a primary residence to repay the mortgage of another property acquired recently. The DGT rules that this is possible provided the new property meets the requirements for a primary residence and the purchase took place within the two years preceding the sale.

Cuestión planteada Si la vivienda a la que trasladará su vivienda puede tener la consideración de vivienda habitual, y, en base a ello, si a la señalada ganancia de patrimonio le es de aplicación la exención por reinversión en vivienda habitual.

The DGT's ruling

La ganancia patrimonial puede quedar exonerada si el importe obtenido se reinvierte en una vivienda adquirida en el plazo de los dos años anteriores a la transmisión de la vivienda habitual. Para ello, la vivienda en la que se reinvierta debe alcanzar la consideración de vivienda habitual según la normativa. La exención será total solo si se reinvierte el importe total obtenido en la transmisión, no solo la ganancia.
