Property owners must declare imputed real estate income if the property is not their primary residence

A query was raised regarding whether a mother must declare imputed real estate income for a property she owns but in which her daughter resides. The DGT ruled that she must declare the income as the property does not constitute her primary residence.

The DGT's ruling

La vivienda habitual requiere una residencia continuada, efectiva y permanente por parte del contribuyente. Para determinarla en caso de duplicidad de domicilios, se considera la vivienda donde se resida por más tiempo en el período impositivo. El simple empadronamiento no es prueba suficiente para acreditar la condición de vivienda habitual. Por tanto, si la propiedad no es la vivienda habitual del titular, este debe imputar la renta inmobiliaria correspondiente.
