The obligation to issue invoices is mandatory, even if the customer waives receipt

A supermarket chain inquired whether it could offer customers the choice of receiving an electronic invoice, a paper invoice, or no invoice at all. The Directorate General for Taxes (DGT) ruled that the issuance of an invoice is a formal tax obligation that cannot be altered by private agreements.

The DGT's ruling

La obligación de expedir y entregar facturas es una obligación tributaria formal que no puede ser alterada por convenios entre las partes, por lo que el destinatario no puede renunciar a su recepción. Para que una factura sea electrónica, requiere el consentimiento informado del destinatario, el cual puede ser expreso o tácito. El consentimiento debe permitir la revocación en cualquier momento. La factura electrónica debe garantizar la autenticidad de su origen, la integridad de su contenido y su legibilidad.
