Amounts received from the capitalisation of a mutual society benefit are classified as employment income

A taxpayer inquired about the tax classification of an amount received following the capitalisation of a benefit for disabled children due to the dissolution of a mutual society. The DGT ruled that such amounts must be classified as employment income.

The question raised

Corresponding tax classification for the amount received.

The DGT's ruling

Amounts received as a consequence of the dissolution and liquidation of a social welfare mutual society must be classified as income from employment. Article 17.2.a).4 of Law 35/2006 applies, which considers as income from employment the benefits from insurance contracts with mutual societies whose contributions have been a deductible expense or subject to a reduction.
