Income from the assignment of intellectual property rights may be classified as employment income or business income

A taxpayer has enquired about the classification for Personal Income Tax (IRPF) purposes of income derived from transferring the exploitation rights of literary and musical works. The Directorate General for Taxes (DGT) indicates that such income may be treated as employment income or income from economic activities, depending on how the work is performed.

The question raised

Classification in the Personal Income Tax (IRPF) of the amounts obtained from said transfer.

The DGT's ruling

Income from the assignment of exploitation rights of a work may be considered income from employment. However, if the author independently organizes means of production and human resources to intervene in the production or distribution, it shall be classified as income from economic activities. In any case, these amounts must be included in the general taxable base of the Personal Income Tax (IRPF).
