Transfer of savings between own accounts does not constitute income subject to Personal Income Tax

The applicant asks whether transferring savings between bank accounts held jointly with their spouse has implications for Personal Income Tax (IRPF). The Directorate General for Taxes (DGT) responds that the mere transfer of cash does not constitute the acquisition of income and, therefore, is not taxable.

The question raised

Taxation under Personal Income Tax regarding the aforementioned transfer. Accreditation before the State Tax Administration Agency

The DGT's ruling

The transfer of cash to a bank account is not included in the scenarios that determine the acquisition of income subject to taxation pursuant to Article 6 of the Personal Income Tax Law. Nevertheless, the Administration may assess the means of evidence to determine the origin of the money in each specific case. The DGT cannot rule on which means of evidence are valid to justify the origin of the funds.
