Excess investment exceeding the maximum annual base cannot be carried forward to future tax years

The taxpayer asks whether the amount invested in newly established companies that exceeds the annual deduction limit can be applied in subsequent years. The DGT rules that the regulations do not allow this excess to be carried forward to future tax periods.

The question raised

Whether the excess of the amounts invested over the maximum deduction base may be deducted in future tax years.

The DGT's ruling

Article 68.1 of the Personal Income Tax Law establishes a maximum deduction base of 60,000 euros per year. The regulation does not contemplate the possibility of deducting in subsequent tax years the amounts paid for the subscription of shares or holdings that could not be deducted due to having exceeded said annual limit.
