The real value of the assets must be declared if it is higher than the value determined by the Administration

A query is made regarding which value must be used in the inheritance tax self-assessment when the values in the partition agreement or the partition deed are higher than those of the Tax Agency. The DGT responds that the higher values must be reported.

Question posed: The value that must appear in the Inheritance and Gift Tax self-assessments.

The DGT's ruling

In mortis causa transfers, the tax base is the real value of the assets and rights. Interested parties must report in the declaration the real value they attribute to each asset, which shall prevail over the value verified by the Administration if it were higher.
