Bare owners of a property are not required to impute real estate income if a life usufruct exists

A taxpayer acquired the bare ownership of a property with the obligation to pay civil maintenance to the usufructuary. The DGT has ruled that real estate income should not be imputed and that these maintenance payments are not tax-deductible.

The DGT's ruling

La renta imputada por bienes inmuebles corresponde al titular del derecho real de usufructo. Por tanto, el nudo propietario no tiene que imputar renta inmobiliaria por la vivienda. Asimismo, las cantidades satisfechas en concepto de alimentos no admiten desgravación en el impuesto.
