Benefit-in-kind for company car rentals valued at 20% of new market value

An employee uses a company vehicle under a rental agreement for both professional and private purposes. The DGT clarifies how to value this benefit-in-kind and which expenses are included in its calculation.

The question raised

Valuation of the benefit-in-kind.

The DGT's ruling

When the vehicle is not owned by the company, the benefit-in-kind for its use is 20% per annum of the market value of the vehicle as if it were new. This value is determined according to the market at the time the renting contract was entered into. The valuation includes insurance, taxes, and maintenance, but excludes fuel, which constitutes an independent benefit if paid by the company. The imputation is based on the availability of the vehicle for private use, rather than on actual use or mileage.
