Reinvestment exemption cannot be applied if the sold property was not a primary residence in the two preceding years

The taxpayer asks whether they can apply the reinvestment exemption when selling a former property and using the proceeds to pay off the mortgage on their current home. The Tax Agency responds that this is not possible because the sold property was neither their primary residence at the time of sale nor had it been for the two years prior to the sale.

The DGT's ruling

Para aplicar la exención, la vivienda transmitida debe ser la vivienda habitual en el momento de la venta o haberlo sido en cualquier día de los dos años anteriores. En este caso, la vivienda vendida no cumplía ese requisito de habitualidad temporal. Además, si se usa financiación ajena, el importe a reinvertir es el valor de transmisión menos el principal pendiente del préstamo.
