Reinvestment exemption for principal residence may apply if time limits and residency requirements are met

The inquirer asks whether they can benefit from the principal residence reinvestment exemption by purchasing a new home before selling their current one. The DGT explains that the exemption requires both properties to be principal residences and that the acquisition must take place within two years before or after the sale.

The DGT's ruling

Para la exención, la vivienda debe ser habitual tanto la transmitida como la adquirida. La adquisición de la nueva vivienda puede realizarse en un plazo de dos años anteriores o posteriores a la fecha de transmisión de la anterior. La reinversión debe efectuarse en un periodo no superior a dos años desde la transmisión. Si la reinversión es inferior al importe obtenido, solo se excluirá la parte proporcional de la ganancia.
