Reinvestment exemption for principal residence may apply following community property liquidation with compensation

A taxpayer inquired whether the exemption for reinvestment in a principal residence could be applied after receiving part of a property through a dation in payment to offset a debt arising from the liquidation of community property. The Directorate General for Tax (DGT) ruled that, since the financial compensation generates a capital gain, the exemption may be applied provided the requirements for a principal residence are met.

The question raised

The DGT's ruling
