Prescription eyeglass frames taxed at 10% if accrual occurs after 29 June 2017

A company requested clarification on whether it could rectify VAT on previously sold eyeglass frames using the 10% rate instead of 21%. The DGT clarified that the reduced 10% rate applies to prescription eyeglass frames only if the accrual takes place after the legal amendment of 29 June 2017.

The question raised

Possibility of modifying the tax base as set forth in Article 80.Four.

The DGT's ruling

The supply of eyeglass frames, considered in isolation, is taxed at 10% provided that the accrual occurs after 29 June 2017. For transactions with accrual prior to that date, the applicable rate is 21%. If the reduced rate was erroneously applied before said date, the output tax must be rectified in accordance with Articles 88 and 89 of Law 37/1992.
