Reinvestment relief only applies to the portion of the property used as a primary residence

The taxpayer asks whether reinvestment relief can be applied when selling a property if part of it is used for their economic activity. The DGT rules that the relief only applies to the portion that constitutes the primary residence, not to the part used for business purposes.

The question raised

For the purposes of Personal Income Tax, whether, in the event that they transfer their habitual residence and allocate the amount obtained to the acquisition of a new residence, the reinvestment exemption is applicable. Likewise, I calculate, where applicable, the acquisition value of the business portion of the residence and the non-business portion.
