Loss on shares can be recognised upon dissolution and liquidation

The consultant asks whether a loss on shares of a company with nil value can be declared. The DGT responds that a loss is recognised upon the dissolution and liquidation of the company.

The question raised

Possibility of calculating said loss in the Personal Income Tax return and when to do so.

The DGT's ruling

To calculate a capital loss resulting from the separation of partners or the dissolution of companies, there must be a difference between the value of the social liquidation quota and the acquisition value. It is necessary to proceed previously with the dissolution and liquidation of the company. The tax period for declaring the loss is that in which said liquidation occurs.
