Assets received as gifts may be depreciated if the economic activity continues

A taxpayer inquired whether they could depreciate a taxi licence and a vehicle received as a gift from their father. The DGT ruled that this is possible provided the recipient continues the donor's economic activity.

The question raised

Whether the taxpayer may depreciate these assets and, where applicable, the depreciation base.

The DGT's ruling

Assets acquired by donation are depreciable provided that the donee continues the exercise of the economic activity carried out by the donor. The acquisition value shall be the market value, increased by the expenses and taxes inherent to the acquisition, which shall coincide with the book value in the investment asset register.
