Rents from assets in a disabled person's protected estate are taxed according to their nature

The DGT responds that rents from such assets are taxed according to their type, and that contributions of the owner's own assets do not generate income or reduce taxable amounts.

The question raised

1) Whether the income derived from the contributed assets is exempt.

The DGT's ruling

Tax benefits for contributions to protected assets do not extend to the income generated by the assets comprising said assets. The assignment of assets from the owner to the protected assets does not constitute a capital gain or loss because the composition of the total assets is not altered. Furthermore, the disposal of assets contributed during the contribution period or in the following four periods entails the regularization of the tax benefits.
