Employer-paid professional fees deemed as in-kind remuneration

An employee asks whether their employer's payment of professional membership fees is taxable under income tax. The DGT rules that such payment constitutes in-kind remuneration and examines its deductibility.

The question raised

Taxation of the amount corresponding to the bar association fees in the Personal Income Tax.

The DGT's ruling

The payment of professional association fees by the employer constitutes remuneration in kind. These fees shall be deductible as an expense from gross employment income only if membership is mandatory for the performance of the work and to the extent that it corresponds to the essential purposes of the institution, subject to an annual limit of 500 euros.
