ITPAJD · exención subjetiva

Municipal company ineligible for ITPAJD exemption as it is not a Public Administration

A limited company owned by a city council has requested clarification on whether it can benefit from ITPAJD exemptions when purchasing rural land. The Directorate General for Taxes (DGT) ruled that, as a private law entity engaged in commercial activity, it does not qualify as a Public Administration, nor is its tax regime legally equated to one.

The question raised

What would be the taxation under the Transfer Tax and Documented Legal Acts Tax.

The DGT's ruling

Local commercial companies, even if they are municipally owned, are governed by private law and cannot be classified as Public Administration. Therefore, they do not enjoy the subjective exemption from the Transfer Tax and Documented Legal Acts Tax (ITPAJD) provided for the State and Public Administrations. The exemption would only apply if their tax regime were equated by law to that of the Administrations, a circumstance which is not proven by the taxpayer.
