Notary, registry and advisory fees may reduce the transfer value in the renunciation of usufruct

A query was raised regarding whether certain expenses can reduce the transfer value in the renunciation of usufruct and the dissolution of co-ownership. The DGT clarifies that these expenses, along with taxes, are either deducted from the transfer value or added to the acquisition value, depending on the circumstances.

The DGT's ruling

En la renuncia al usufructo, los gastos de notaría, registro y asesoría constituyen un menor valor de transmisión para la transmitente. En la disolución del condominio, estos mismos gastos son un menor valor de transmisión para los transmitentes y un mayor valor de adquisición para el adjudicatario. Los gastos de cancelación de hipoteca, notaría y registro por la adquisición por herencia son un mayor valor de adquisición.
