Return of goods requires correction of taxable base by a rectifying invoice

A company asked about the procedure to correct the taxable base after returning goods purchased from a permanent establishment. The DGT responded that a rectifying invoice should be issued applying the applicable tax rate at the time of the original transaction.

The question raised

Procedure for the rectification of the tax base due to the return of goods

The DGT's ruling

When a return of products occurs, the taxable person must rectify the tax base of the supplies of goods by issuing a credit note. The modification of the tax base and the tax amounts must be carried out by applying the tax rate in force at the time the original transactions took place, rather than the rate in force at the time of the rectification.
