Hyaluronic acid gel subject to 10% VAT if it meets pharmaceutical product requirements for direct use

A query was made regarding the applicable tax rate for a hyaluronic acid gel used to prevent post-surgical adhesions. The DGT indicates that the reduced rate of 10% may apply if the product meets specific Combined Nomenclature requirements and is suitable for direct use by the end consumer.

The DGT's ruling

Para aplicar el tipo del 10% a productos farmacéuticos del Capítulo 30 de la Nomenclatura Combinada que no sean medicamentos, deben cumplirse cuatro requisitos conjuntamente: estar en la categoría 30, no ser medicamentos, no estar exentos y ser susceptibles de uso directo por el consumidor final. Este último requisito implica que, por sus características objetivas, el producto pueda aplicarse directamente sobre un paciente, independientemente de si permanece en el cuerpo o no. Si no se cumplen estos requisitos, se aplicará el tipo general del 21%.
