Dividends from Spanish companies are taxed as income from movable capital in the savings tax base

A taxpayer has enquired about the taxation of dividends received from a Spanish public limited company. The DGT has ruled that these constitute income from movable capital, which is included in the savings tax base.

The question raised

Taxation of these dividends in the Personal Income Tax.

The DGT's ruling

Dividends received are considered income from movable capital pursuant to Article 25.1.a) of the Personal Income Tax Law (LIRPF) and are subject to withholding and payment on account. They must be calculated at their gross amount in the savings tax base. There is an exemption on the gross amount with an annual limit of 1,500 euros, subject to conditions regarding the acquisition and transfer of securities.
