Transfer of own goods to a warehouse in the Canary Islands does not need to be reported on Form 340

A company sought clarification on whether the transfer of goods from mainland Spain to its own warehouse in Gran Canaria should be declared on Form 340. The Directorate General for Taxes (DGT) ruled that, as these are the company's own goods, no supply of goods has occurred; therefore, there is no obligation to report such an operation.

The question raised

The manner in which operations involving the shipment of goods to the Canary Islands must be reported in the declaration report using "form 340".

The DGT's ruling

For a delivery of goods to exist, there must be a transfer of powers of disposal between two independent parties. In the case of transfers of own goods to a warehouse of the same company, there are no two independent parties, and therefore there is no delivery of goods. Consequently, the issuance of an invoice and the reporting of the operation in form 340 are not required.
