IRPF · valor de adquisición

Acquisition value verified by the Autonomous Community must be used for Personal Income Tax (IRPF)

A taxpayer inquired which acquisition value should be used to calculate capital gains on a garage following a value verification by the Autonomous Community. The Directorate General for Taxes (DGT) ruled that the verified value must be applied.

The question raised

Acquisition value of the real estate for the purposes of calculating capital gains in Personal Income Tax (IRPF).

The DGT's ruling

The acquisition value for Personal Income Tax (IRPF) is composed of the actual purchase amount plus expenses, taxes, and investments. However, according to the jurisprudence of the Supreme Court, if the Autonomous Community performs a verification of values for Transfer Tax, the verified value must be taken into account as the actual acquisition amount.
