A taxpayer inquired whether they could claim 100% of the tax relief for investment in their main residence after marrying under the community property regime, having acquired the property while single. The Directorate General of Taxes (DGT) ruled that repayments made using community property funds must be allocated equally to both spouses.

Posibilidad por parte del cónyuge que adquirió de soltero la vivienda de practicar la deducción en función del 100 por ciento de las cantidades satisfechas por la amortización del préstamo o el 50 por ciento cada uno de los cónyuges.
Al existir sociedad de gananciales y ser la vivienda el hogar familiar, la propiedad se divide según las aportaciones de cada uno. Las cantidades satisfechas con fondos gananciales para amortizar el préstamo se imputan al 50% a cada cónyuge. El titular originario solo podrá computar el 50% de dichos pagos gananciales, además de sus propias aportaciones privativas. El cónyuge que adquiere la parte indivisa mediante fondos gananciales no tiene derecho a la deducción porque esta fue suprimida en 2013.
