Grants received by a homeowners' association are taxed as capital gains for Personal Income Tax

A homeowner has enquired about the taxation of an energy efficiency grant received by their homeowners' association. The Directorate General for Taxes (DGT) has ruled that such income is attributed to the individual owners as capital gains in the year it is received.

The question raised

Taxation of the subsidy received.

The DGT's ruling

Homeowners' associations are not taxpayers; instead, income is attributed to their members according to their participation coefficient. The subsidy received qualifies as a capital gain as it represents a variation in the value of the assets. Said gain must be imputed to the tax period in which the collection occurs and attributed to those holding the status of owners at that time.
