No obligation to file informative returns for foreign assets if only a mere expectation of right exists

A taxpayer inquired whether they must file an informative return regarding real estate in Argentina following the death of a decedent. The Directorate General of Taxes (DGT) ruled that if, as of 31 December 2017, only an expectation of rights existed due to the inheritance not yet being accepted, there is no obligation to report.

The DGT's ruling

La obligación de informar sobre bienes inmuebles en el extranjero no existe si los valores de adquisición no superan los 50.000 euros. Para determinar este límite, debe usarse el valor de adquisición y no el valor catastral. Si a 31 de diciembre de un año el interesado solo posee una expectativa de derechos derivados de su condición de futuro heredero, sin haber aceptado la herencia, no está obligado a presentar la declaración informativa.
