Banking Mutualities' benefits from 1967-1978 counted as 75% work income

The consultant asks how benefits from Banking Mutualities contributions made between 1975 and 1978 are taxed. The DGT states that, in line with Supreme Court jurisprudence, these benefits must be included in the taxable base as work income at 75%.

The question raised

Application of the second transitional provision of Law 35/2006 to the Social Security benefit derived from contributions to the Banking Labor Mutual Fund.

The DGT's ruling

Contributions to the Banking Labor Mutual Fund made between January 1, 1967, and December 31, 1978, were not deductible under the legislation in force at that time. Therefore, the second transitional provision of Law 35/2006 applies, whereby 75% of the retirement or disability benefits received must be included in the taxable base. This criterion is based on Supreme Court Ruling 707/2023.
