Ownership requirement for foreign shares depends on status as of 31 December

A taxpayer asks whether they must declare foreign shares bought and sold during the year if not owner as of year-end. The DGT responds that no reporting obligation exists if not owner as of 31 December, unless ownership was lost at another point during the year.

La obligación de presentar la declaración informativa sobre bienes y derechos situados en el extranjero se aplica a quienes sean titulares o titulares reales a 31 de diciembre. También afecta a quienes hayan sido titulares en cualquier momento del año y hayan perdido dicha condición antes del 31 de diciembre, debiendo informar sobre la fecha en que se produjo la extinción. Si el contribuyente no es titular ni titular real a 31 de diciembre, no tiene la obligación de presentar la declaración informativa.
