Dividends are treated as mobile capital income in savings base

The DGT confirms that dividends are considered mobile capital income and that the double taxation deduction was abolished in 2007.

The question raised

Taxation of dividends received by a shareholder corresponding to their shareholding in a company, as well as whether it is possible to apply tax benefits to avoid double taxation with Corporate Income Tax.

The DGT's ruling

Dividends are considered full returns on movable capital pursuant to Article 25.1.a) of the Personal Income Tax Law (LIRPF). These amounts constitute savings income and must be included in the savings tax base. The transaction is subject to a withholding tax of 19 percent. The deduction for double taxation of dividends does not exist, having been abolished since January 1, 2007.
