Political parties must file Corporation Tax returns for all income

A query was raised regarding whether political parties are required to file Corporation Tax returns for all their income or only for non-exempt income. The Directorate General for Taxes (DGT) has ruled that they must declare the totality of their income, including both exempt and non-exempt amounts.

The question raised

Whether there is an obligation to file the corporate income tax return corresponding to the 2021 fiscal year and subsequent fiscal years.

The DGT's ruling

Political parties are obliged to file and sign the Corporate Income Tax return for the totality of their income, including both exempt and non-exempt income, pursuant to Article 124.3 of the LIS. Notwithstanding the contrary provisions of Article 11.3 of the LOFPP, the LIS is applicable as it regulates a specific factual scenario. The return must be filed within 25 calendar days following the 6 months after the end of the tax period.
