Selling a recreational craft generates a capital gain or loss for Personal Income Tax purposes

The taxpayer asks how the sale of a personal recreational craft is taxed. The Directorate General for Taxes (DGT) responds that the transaction generates a capital gain or loss, which must be included in the savings tax base.

The question raised

Taxation of the sale of the vessel in the Personal Income Tax (IRPF).

The DGT's ruling

The capital gain or loss is determined by the difference between the acquisition and transfer values. The acquisition value must be reduced by depreciation due to use, as it is a durable consumer good. The transfer value is the actual amount of the disposal, deducting inherent expenses and taxes, provided it is not lower than the market value.
