Requirements for the reinvestment exemption when building a new primary residence

The taxpayer inquires about the timeframe for selling their current home and applying the reinvestment exemption after building a detached house through self-construction. The DGT rules that the amount must be reinvested within two years and that construction must be completed in accordance with the deadlines set out in the Regulations.

Question posed: What period would I have to sell my apartment and be able to apply the reinvestment exemption.

The DGT's ruling

For the exemption due to reinvestment in construction, two conditions must be met: 1) the entire amount obtained from the sale must be applied to the construction within a period of two years (prior to or following the transfer). 2) the work must be completed within a period not exceeding four years from the start of the investment, except for legal extensions. The investment may be carried out in the two years prior to or following the sale of the old dwelling.
