Tax treatment and calculation of yield in the partial surrender of a life insurance policy

A taxpayer has requested clarification regarding the tax treatment of a partial surrender of a life insurance policy taken out in 1994. The Directorate General of Taxes (DGT) clarifies how to calculate the yield, the application of age-related reductions, and the obligation to withhold tax.

The DGT's ruling

En rescates parciales, el rendimiento de capital mobiliario es la diferencia entre lo percibido y las primas de mayor antigüedad más su rentabilidad. Para primas pagadas antes de 1994, se puede aplicar una reducción según la disposición transitoria cuarta de la Ley 35/2006. La compensación fiscal de la disposición transitoria decimotercera fue suprimida en 2015. La entidad aseguradora debe retener sobre el rendimiento calculado, pero solo aplicará la reducción si el contribuyente comunica previamente el importe total de los capitales diferidos.
