Joint tax declaration not possible with a daughter over 18

A mother with a single-parent family asks whether she can file her tax return jointly with her two daughters. The DGT confirms that she cannot include a daughter who has reached 18, but can do so with the younger daughter.

Question posed - Whether she may file a joint tax return with her two daughters.

The DGT's ruling

Joint taxation with children requires that they be minors or incapacitated adults. As the eldest daughter is 18 years old as of December 31, 2020, she does not form part of the family unit for the joint tax return of that fiscal year. Nevertheless, the taxpayer may still file a joint tax return with her younger daughter.
