Contributions for water infrastructure works exempt from VAT

A commercial entity managing the full water cycle asks whether financial contributions from a Council for improving water infrastructure are subject to VAT. The DGT states these amounts do not constitute service payments or price-linked subsidies.

The question raised

Clarification of the binding ruling of March 18, 2025, inquiry V0323-25, as a consequence of the contribution of new relevant facts to the response. In particular, the question concerns the deductibility of Value Added Tax amounts incurred, insofar as the inquirer states that they carry out exclusively taxable and non-exempt operations of the Tax.

The DGT's ruling

Monetary contributions to finance improvement works on water cycle infrastructure do not constitute consideration for services nor subsidies linked to the price, as they do not meet the requirements of direct linkage to the price or benefit to the acquirer. If the entity carries out exclusively taxable and non-exempt operations, it does not have a dual nature and may fully deduct the tax amounts incurred in its acquisitions.
