Life and funeral insurance premiums are not deductible from business net income

A professional using the direct estimation method has enquired whether life and funeral insurance premiums are tax-deductible. The DGT has ruled that only health insurance premiums are deductible, subject to certain limits.

The question raised

Whether the premiums paid for said insurance can be considered a deductible expense for the determination of the net income from the activity.

The DGT's ruling

Life and death insurance premiums are not deductible as they are not provided for in the special rules of Article 30.2 of the Personal Income Tax Law (LIRPF). Only health insurance premiums for the coverage of the taxpayer, their spouse, and children under 25 years of age living with them are considered deductible expenses, subject to the limits established in Rule 5, letter a) of said regulation.
