Obligation to issue invoices for VAT-exempt analysis services if the provider is not an insurance, management, or credit entity

An association of investment institutions has inquired whether analysis services exempt from VAT must be invoiced. The DGT has ruled that there is an obligation to issue an invoice when the providers are entrepreneurs other than insurance companies, investment management companies, pension fund managers, or credit institutions.

The question raised

Obligation to invoice the described analysis services that are exempt from Value Added Tax under the terms provided in the binding response of this management center dated January 4, 2019 (number V0046-19).

The DGT's ruling

Business owners or professionals are obliged to issue an invoice for exempt services if these are deemed to be performed within the territory of application of the tax, the Canary Islands, Ceuta, or Melilla. The exception of not invoicing does not apply when the provider is something other than insurance entities, management companies of collective investment institutions, pension fund managers, securitization funds, or credit institutions. Providers may request an exemption from this obligation before the AEAT if it is justified by sector practices or technical conditions.
