Profit from selling a primary residence of a person over 65 may be exempt from income tax

A taxpayer over 65 asks whether the sale of a property that has been their main residence for the past five years may be exempt. The DGT responds that exemption applies if it can be proven the property has been their main residence for at least three years.

The DGT's ruling

La transmisión de la vivienda por mayores de 65 años está exenta si la edificación constituye su vivienda habitual en ese momento o lo fue en los dos años anteriores. Para ser vivienda habitual, debe haber sido habitada de forma efectiva y permanente durante un plazo continuado de al menos tres años. La residencia debe acreditarse por cualquier medio de prueba admitido en Derecho, advirtiendo que el empadronamiento no es suficiente por sí solo.
