Segregation and separation of co-ownership interests taxed separately as documented legal acts

A query was made regarding the taxation of a deed involving the segregation of part of an estate and the subsequent allocation of that part to one of the co-owners. The DGT has determined that two distinct agreements are formed, each subject to the tax separately.

The DGT's ruling

La segregación de una finca constituye una convención que tributa por la cuota variable de actos jurídicos documentados, siendo sujeto pasivo todos los comuneros. La adjudicación de la parte segregada al comunero que se separa constituye una segunda convención que también tributa por actos jurídicos documentados, siendo sujeto pasivo el comunero que se separa. En la adjudicación, si el comunero se lleva la parte que le corresponde por su cuota, no hay transmisión sino una transformación de su derecho.
