Para que se produzca la variación en el valor del patrimonio, el crédito debe ser judicialmente incobrable mediante resolución judicial firme (en concurso de acreedores o ejecución forzosa) o cumplir las condiciones de imputación temporal del artículo 14.2.k) de la Ley del IRPF. En este caso, al no haber resolución judicial de imposibilidad de cobro ni concurrir las circunstancias legales, no hay pérdida patrimonial.
