Part-time employment is eligible for the Canary Islands Investment Reserve

A lawyer in the Canary Islands has requested clarification on whether hiring staff on a part-time basis or through trainee contracts qualifies for the Canary Islands Investment Reserve (RIC). The Directorate-General for Tax (DGT) has ruled that when calculating the average workforce, the contracted working hours must be taken into account in relation to a full-time working week.

The question raised

Whether, for the purpose of materializing the Investment Reserve in the Canary Islands (RIC), it is appropriate to hire a person on a part-time basis under a probationary employment contract and, likewise, whether the hiring of a person on a part-time basis is appropriate.

The DGT's ruling

For the calculation of the total average workforce and its increase, the number of persons employed shall be taken in accordance with labor legislation, considering the contracted working hours in relation to full-time working hours. This applies both to the creation of jobs related to initial investments (letter B) and to the creation of jobs that do not constitute initial investment (letter B bis).
