Capital gains from compensation are taxed in the year the court ruling becomes final

A homeowners' association has enquired as to when it must pay tax on compensation received following a lawsuit that has not yet reached a final judgment. The Directorate General of Taxes (DGT) has ruled that the capital gain shall be attributed to the tax period in which the judicial resolution becomes final.

The DGT's ruling

La indemnización recibida por una comunidad de propietarios se califica como ganancia patrimonial, computándose la diferencia entre la cantidad percibida y la parte proporcional del valor de adquisición correspondiente al daño. Solo existe ganancia si la indemnización excede del coste de las reparaciones. Según el artículo 14.2.a) de la Ley del IRPF, si la cuantía está pendiente de resolución judicial, los importes se imputarán al periodo impositivo en que la sentencia adquiera firmeza.
