Reinvestment exemption cannot be applied if the new property was acquired outside the two-year prior period

A taxpayer inquired whether they could apply for the reinvestment exemption after selling their primary residence and using the proceeds to repay the mortgage on a property acquired previously. The Directorate General for Taxes (DGT) ruled that this is not applicable because the new property was purchased outside the legal two-year window preceding the sale.

The DGT's ruling

Para la exención por reinversión, la nueva vivienda debe adquirirse en el plazo de dos años anteriores o posteriores a la transmisión de la antigua. En este caso, la adquisición de la nueva vivienda ocurrió el 13 de septiembre de 2018 y la venta de la anterior el 22 de febrero de 2021, superando el plazo de dos años previos permitido. Por tanto, no se cumple el requisito temporal para acogerse a la exención.
