Tax deduction for main residence cannot be applied to portion acquired after 2012

A taxpayer inquired whether they could claim a tax deduction for investment in their main residence after acquiring the remaining 50% through the termination of a co-ownership agreement and a new loan. The Directorate General for Taxes (DGT) ruled that the portion acquired in 2019 is not eligible for the deduction, although the taxpayer may retain the deduction for the portion owned prior to 2013.

Cuestión planteada Si puede continuar practicando la deducción por inversión en vivienda habiutal, por el 50 por ciento de titularidad que ya ostentaba sobre la misma, por las cantidades que satisfaga por amortización del principal e intereses del nuevo préstamo.

The DGT's ruling

Respecto al 50% de la vivienda adquirido en 2019 por extinción de condominio, no es aplicable el régimen transitorio y no hay derecho a deducción. Sobre el 50% poseído antes de 2013, se mantiene el derecho a la deducción. La sustitución de un préstamo por otro para amortizar el anterior no agota la posibilidad de practicar la deducción, siempre que el nuevo préstamo se dedique efectivamente a la amortización del préstamo originario.
