Deadline for 40% pension plan redemption reduction (pre-2007 contributions) ends 31 December 2024 for 2022 contingencies

The inquirer asks about the deadline to apply the 40% reduction for contributions made prior to 2007 following a collective redundancy. The Directorate General for Taxes (DGT) clarifies that if the redemption is due to early retirement, the contingency occurs upon the termination of the employment relationship, meaning the deadline for the reduction expires on 31 December 2024.

The question raised

Question posed: Period for applying the 40% reduction provided for in the transitional regime.

The DGT's ruling

Pension plan benefits are considered income from employment. If retirement is claimed early due to collective redundancy, the contingency occurs when the requirements for early collection are met. To apply the 40% reduction to contributions made prior to 2007, the benefit must be received in the tax year the contingency occurs or in the two following years. In this case, as the contingency occurs in 2022, the period ends on December 31, 2024.
