Online training may be VAT exempt if classified as an educational service rather than an electronically supplied service

A company sought clarification regarding the VAT treatment of its online training activities, certification issuance, and software sales. The DGT explains that exemption depends on whether the teaching is delivered by a teacher via remote communication or if it is an automated service without significant human intervention.

The DGT's ruling

Los servicios de enseñanza online están exentos de IVA si se consideran servicios educativos (con profesor y comunicación remota) y cumplen los requisitos de entidad autorizada y materia incluida en planes de estudio. Si el servicio es automatizado (descarga de contenidos o cursos grabados), se considera servicio prestado por vía electrónica y tributa al 21%. La emisión de títulos es accesoria a la formación, pero la expedición de títulos a alumnos de otras academias tributa al 21%. La venta de software y manuales tributa al tipo general.
